You should keep a copy of these Terms and Conditions and any redemption order you make for your future reference. These Terms and Conditions may be revised from time to time at our discretion. Any changes we make will apply to any redemption orders received after the date of any changes made. The use of SuperChecks implies the acceptance of these Terms and Conditions and Privacy Policy of the Program.
1. DEFINITIONS
1.1. SuperChecks: Is the name given to the online merchandise and Gift Certificate/Cards reward platform for which these Terms & Conditions apply. SuperChecks is a web based platform that allows its Participants anywhere in the United State of America to earn Points and redeem these Points for Prizes.
1.2. Participants: They are individuals or companies that receive and registered a SuperChecks code themselves according to the criteria established by the eligibility Administrator and own a valid account to participate in the program.
1.3. Administrator: Is the company hired by the Campaign Sponsor to administrate the Program. In this case: Grass Roots America.
1.4. Campaign Sponsor: Entity or company that utilizes SuperChecks to motivate and/or recognize its employees or business partners to achieve established goals.
1.5. Eligibility Conditions: Individuals or companies that follow the established criteria in the program´s rules. In case of individuals, they must be above 18 years.
1.6. Prizes: They are rewards received by participants in the Program for accomplishing incentive activities defined by the Sponsor. The rewards can be gift certificates, merchandise, travels, services and others.
1.7. Program: It is the program or promotion running on SuperChecks that the Campaign Sponsor has created to achieve its sales goals, loyalty growth, customer retention and/or any other goal that the Campaign Sponsor may define.
1.8. Points: It is the incentive currency that the Participants earn to be exchanged for Prizes. Each point is equal to $1 USD.
1.9. SuperChecks Codes: They are the secure sixteen digits code used in the SuperChecks.

3. TERMS AND CONDITIONS OF USE OF WEBSITE
3.1. The SuperChecks service is a membership based service and you will be required to submit a secure sixteen digits code of your SuperChecks or use your previous credentials (user name and password) prior to gaining entry into the service.
3.2. You are entirely responsible for maintaining the confidentiality of your password and account details. If you believe that your password has become compromised you should contact us as soon as possible and (subject to security checks) we will change your password. We will not be responsible to you if there is an unauthorized access to your account and/or an unauthorized account activity as a result of your password becoming compromised, unless this is due to our negligence. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
3.3. We cannot guarantee that use of this website will be compatible with all hardware and software which may be used by visitors to the site.
3.4. We cannot guarantee periods of availability of the website or that access to the website will be uninterrupted. Subject to clause 6, we shall not be liable to you in respect of any claim or loss (including for the avoidance of doubt any loss of profit, loss of business, wasted management time or other consequential loss) incurred by you which arises as a result of any downtime or non-availability of the website.
3.5. When you visit or use this site or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail, phone or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
3.6. We reserve the right to revise these Terms and Conditions at any time and users are deemed to be appraised of and bound by any changes to these Terms and Conditions. We reserve the right to change elements or terms of use, including, but not limited to Prizes. Prize Point values, rules, privacy policies, mechanism to validate information and others. If a Prize is discontinued, reasonable efforts will be made to offer a substitute of equivalent quality. All Prize offerings are subject to availability. We may make model substitutions of equivalent value without advance notice when necessary.
4. INTELLECTUAL PROPERTY
4.1. This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, brands, layout, look, content, appearance and graphics. It is protected by intellectual property laws including, but not limited to, copyright, trade mark.
4.2. You may view, use, download and store the material on this website for personal and research use only. Commercial use is not permitted. The re-distribution, re-publication, or otherwise making available of the material on this website to third parties without our prior written consent is prohibited and will be penalized accordingly to the law.
4.3. Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offence
5. ACCURACY OF INFORMATION
5.1The information in this website is given in good faith. It is subject to change without notice including but not limited to the Prize pricing. We are not liable for any inaccuracies or changes without notice and make no representation and give no warranty as to the accuracy of the information pertaining Prizes and other website content. The information in this website should not be relied on and does not constitute any form of advice or recommendation.
6. LIABILITY
6.1. We will not be responsible to you for any loss or damage you may suffer (however it may arise, including our negligence) as a result of your access to or use of this website or any materials on this website, except where the loss or damage is:
6.1.1. Caused by our fraud;
6.1.2. Caused by any other matter for which it would be illegal for us to exclude or attempt to exclude our liability; or
6.1.3. Covered by our returns policy, in which case the provisions of our returns policy will apply.
6.2. All items are manufactured by independent suppliers. Grass Roots America Inc., its subsidiaries and divisions makes no guarantees, warranties or representations of any kind, expressed or implied, with respect to such items, and shall not be liable for any loss, expense, accident, or inconvenience that may arise in connection with the use of such items, or as a result of any defect in or failure of such items.
6.3. The Participants are the only responsible for the choice of the Prizes and for the use they will make of them. Neither the Campaign Sponsor nor the Administrator are responsible for the use Participants make of the Prizes or the damages (direct or indirect) that they can cause to the Participant or to third parties.
6.4. Neither the Campaign Sponsor nor the Administrator will be responsible for any Participant action that by any means results in fraud to the Program, be it by false information, false notes, redemptions of Prizes using Points that don´t belong to the Participant, ownership of confidential information or any other type of fraud causing loss to the Campaign Sponsor and to the Administrator. If any of these previous circumstances happen, the Campaign Sponsor and the Administrator reserve the right to act legally against anyone who has committed them, being able to use any legally applicable action. It is expressly understood that if a Participant commits any of the previously described actions, this will void any right the Participant may have to redeem the Points accumulated in the Program. The Campaign Sponsor and the Administrator reserve the right to cancel the participation of any Participant who has committed any of the previously described actions in promotions that the Campaign Sponsor and the Administrator make and that the Participant participates in the future.
7. TERMINATION
7.1. We make the SuperChecks service available to you at our discretion and may terminate your access to the service or the Program at any time without notice. Some circumstances in which we may choose to exercise our right to terminate your access to the service include but not limited to:
7.1.1. If you are in breach of these terms and conditions; or
7.1.2. Where you participate in a Program benefits scheme through a corporate membership, in the event that you cease to be an employee of the corporate member; or our agreement with the corporate member for the provision of the benefits scheme should terminate for any reason
7.2. Once notified about the end of a Program, when such notification exists, Participants will have 30 continuous days to redeem the Points they have accumulated and to choose their Prizes. After this time, Participants who did not redeem their Points will be eliminated from the system and from the Participants´ records and nor the Campaign Sponsor nor the Administrator will be held responsible for the unredeemed Points. Also, after the 30 continuous day period, the Administrator can cancel or totally eliminate from the system participants´ personal accounts and they will no longer have access to the system and to their account information.
7.3. The Campaign Sponsor reserves the right to cancel Participants´ accounts inactive for twelve (12) months running. All the Points that Participants have accumulated will be voided and neither the Sponsor nor the Administrator will hold responsibility for the loss of Participant´s Points.
7.4. The Campaign Sponsor reserves the right to verify at any given time that each Participant complies with this Terms and Conditions. The Campaign Sponsor is excluded of any obligation (including the Prize delivery or any other) before any individual or company that has participated (or intended to participate) in the Program that does not comply with this Terms and Conditions even if the intended Participant has already received Prizes from the Program.
7.6. If the Campaign Sponsor or the Administrator, or their respective affiliates, employees or agents suspect that there has been electronic forgery in the Program or determine that actually there has been, or if technical difficulties compromise the Programs integrity, or any other type of fraud, the Campaign Sponsor reserves the right to cancel the affected accounts and annul, modify or finish immediately the Program besides taking into consideration the suspected records and Participants cannot complain before either Campaign Sponsor and the Administrator.
8. PLACING REDEMPTION ORDER
8.1. To redeem your SuperChecks Points for Prizes and when submitting your redemption order you are accepting to acquire the Prizes at the Point value set out in the order. We are not obliged to supply the Prizes to you until we have acknowledged your order and it has been approved for processing. For an order to be approved we will verify that you have complied with all the Terms and Conditions that govern this website. This process may take up to 1 working day.
8.2. If you discover you have made a mistake with your order please contact our Customer Services Team immediately at superchecks_helpdesk@grassrootsamerica.com. Please do this before we confirm your order. We are unable to rectify mistakes after this time.
8.3. If you order software or any other Prize that have their own terms and conditions from us you will also be bound by the terms of the software license supplied with that software
8.4. Point values for Prizes are checked regularly. If we find the price has changed when we receive your order we will contact you and ask if you wish to proceed. If you do not respond, we will treat your order as cancelled, notify you and refund your Points. If we are unable to accept your order for other reasons, then we shall at our option refund any Points related to that redemption order and notify you with an explanation.
8.5. Despite all possible care has been taken to ensure that each item is accurately described, descriptions cannot be guaranteed as manufacturers´ specifications may change, in which case we will do our best to offer you a substitute item of the same or better quality at the same Point value. Sizes quoted are approximate. Installation and batteries are not included unless otherwise specified.
8.6. The product’s images are reference and do not represent the exactly item or color.
9. CANCEL REDEMPTION ORDER
9.1. Due to our rapid order processing system; we cannot cancel an order already placed and approve, this means that you only have less than 24 hour to cancel or correct any incorrect information.
10. DELIVERY
10.1. We aim to deliver most Prizes to all mainland addresses within 10 working days from the time that your order is approved. There will be some items (approximately 10%) that are delivered in longer periods of time, but usually within 6 weeks. Some items may be delivered in multiple shipments. Large items as larger TVs (20" and above), large home appliances and furniture can only be delivered to mainland addresses. Please make claims for non-deliveries items within 20 working days of placing your order.
10.2. We aim to make 2 attempts for delivery the Prizes, in the event that the prizes couldn’t be delivery on those 2 attempts and is needed to be reshipped, you will be responsible for the corresponding incremental cost.
10.3. All the Gift Card/Certificates will be delivered by USPS, in that sense the delivery accuracy will depend on the information provided by you. If the item is not delivery within 20 working days please make you claim trough the Contact Us section. However if the item wasn’t delivery to you because the information provided by you wasn’t the right one than you will be responsible for the cost of replacing you item.
11. SHIPPING AND HANDLING
11.1. Shipping and handling charges are automatically included in the Point value of the item. You must enter the "Ship To" information for each order before you can redeem the item.
11.2. We are not liable for inaccurate shipping information provided by you. If an item needs to be reshipped, you will be responsible for the corresponding incremental cost. In the case of Gift Cards/Certificates you will also be responsible for the re-issuance cost and/or the complete cost of the item as these Gift Cards/Certificates are already activated.
12. RETURNS POLICY
12.1. You should inspect the Prizes (Merchandise) as soon as you receive them for defects or damage and to ensure they are correct. In the unlikely event that any item you receive is damaged, faulty or incorrect, you should contact the customer service team at superchecks_helpdesk@grassrootsamerica.com or calling to the SuperChecks Award Central at 1-800-6214112 as soon as possible for advice on how to proceed
12.2. No returns will be accepted without prior approval from our SuperChecks Award Central Customer Service department. SuperChecks Award Central Customer Service department will issue a RMA (Return Merchandise Authorization) on all approved returns. SuperChecks Award Central will only accept returns of defective merchandise 30 days from date of shipment.
12.3. All non-merchandise Rewards (for example, Gift Cards/Certificates, travel certificates) cannot be returned
12.4. Please do not return Prizes until instructed to do so. If you are requested to return your Prizes, please ensure that they are securely packaged. Please also provide a full description of the fault and return the defective item to us together with any warranties, manuals and accessories. Prizes damaged in transit on return cannot be replaced.
12.5. Defective Merchandise: If an item is inoperable or defective upon receipt (not due to damage in transit), participant should contact SuperChecks Award Central Customer Service at 1-800-6214112 within 30 days of shipment. SuperChecks Award Central Customer Service will issue a call tag. Upon return of defective merchandise, SuperChecks Award Central will either enter a replacement order, or refund points to the participant. If an item’s defect appears more than 30 days from shipment, SuperChecks will then provide participant with a proof of purchase. Proof of purchase may be used directly with manufacturer to arrange for appropriate service or return.
12.6. Damaged Merchandise: Damaged merchandise should be identified by participant within 48 hours of receipt. Participant should then contact SuperChecks Award Central Customer Service at 1-800-6214112 (identified on packaging) to facilitate the processing of a claim with shipping carrier. In order for the shipping carrier to approve a claim on damaged merchandise, it is imperative that the recipient keep all packing materials, as well as hold the damaged merchandise at the location it was received. Damaged merchandise should not be moved to a different location for pick up. SuperChecks Award Central Customer Service will advise the participant of these policies. Upon verification of a claim, SuperChecks Award Central will then ship a replacement, or if participant prefers, we will refund his/her points. “No-want” returns will not be accepted.
12.7. Exception Returns: SuperChecks Award Central will accept returns for unused merchandise that is not damaged or defective, within the 30-day return period. Once approved, SuperChecks Award Central will provide a RMA (Return Merchandise Authorization) number to the participant. Merchandise must be packed in original packaging and in complete resalable condition. Participant is responsible for return freight to SuperChecks Award Central.
12.8. Most products are backed by a manufacturer warranty.
13. ACCOUNT INFORMATION
13.1. SuperChecks will calculate, register and provide you balance of your account. The account´s history will only be accessible with your credentials. It is the Participant responsibility to take the proper precautions, accessing this information from your computer, preventing other people from having access to this information.
14. EXPIRATION POLICY
14.1. Your SuperChecks have one year expiration date to deposit/enter the secure sixteen digits code into the SuperChecks web site which will be transform in Points and then another expiration policy will take place.
14.2. Points have a one year expiration date. The last day to use/redeem your points will be 12 calendar months after the date you earn your points (deposit your SuperChecks code).

Our online customer service team will assist you with your order, questions or item/return information. We strive to respond to your request within 48 hours, Monday through Friday during normal working hours.
15.1.2. Phone: If your customer service issue is related to Prize delivery and return, you may call us at 1-800-6214112 Monday through Friday during normal working hours.
16. TRAVEL AND EXPERIENCIAL ACTIVITIES
16.1. All travel and activities are subject to availability and available locations are included within the product descriptions. When you book travel or an activity, your booking will be made direct with the supplier and will become subject to the terms and conditions of that supplier. We strongly recommend that you take out adequate insurance cover for the activity you are undertaking.
17. TAXES
17.1. When applicable, sales tax will be included in the Point value of the Prizes.
17.2. If you are an employee of the Campaign Sponsor your Campaign Sponsor is responsible for income tax reporting to the Internal Revenue Service (IRS).
17.3. If you aren’t an employee of the Campaign Sponsor then you are responsible for income tax reporting to the Internal Revenue Service (IRS) for value of SuperChecks received and register in excess of $600 per year.
18. OTHER INFORMATION OF WHICH YOU NEED TO BE AWARE
18.1. Any contract between us shall be governed by Florida law and the courts of Florida shall have exclusive jurisdiction over any dispute. All dealings, correspondence and contacts between us shall be made or conducted in the English language.
18.2. Nothing in these terms and conditions shall affect your statutory rights relating to faulty Prizes or services provided. If you have any doubts about your statutory rights, please contact your local Business Bureau.
